Painting an Unsettling Landscape: Canadian Class Actions 2011 -2014

Recent affirmation of low certification standards, and the convergence of other factors favourable to class actions, are setting the stage for increased use of class actions across Canada. Companies, industry organizations and insurers that have been — or may become — defendants in class proceedings in Ontario would be wise to view the Law Commission of Ontario (LCO) review of the Ontario Class Proceedings Act as a call to action.

The LCO review presents an important and timely opportunity for defendants to advocate for meaningful reform of class action legislation. Given the influence the review may have on class actions legislation throughout Canada, a proactive and engaged defence community throughout the review process is imperative.
